These terms and conditions govern your use of our website, www.tr1bearcanum.com (the "Website").  By accessing or using the website, you agree to comply with these terms.  If you disagree with any part of these terms, you must not use the Website.

 

 

1. Definitions

 

• TR1BE ARCANUM INC. 

• The Site may host quizzes run by third-party organizations, rights-holders, clubs, promoters, or partners (“Quiz Owners”).  Each quiz page will clearly identify the Quiz Owner and link to the Quiz Owner’s privacy policy or contact information.  For quiz submissions, the Quiz Owner will be the controller of any PII (email + consent) sent via that quiz; TR1BE only facilitates transmission unless otherwise agreed in writing (see Section 7).

 

 

3. Information we collect

 

We may collect the following categories of information:

 

a. Information you provide directly

 

• Contact information: name, email address, phone number (when submitted via contact forms, newsletter signups, or other forms). 

• Account information: username, password (if you register).

• Payment information: payment card details where applicable (via third-party payment processors).

• Messages you send to us (support, enquiries).

 

b. Information collected automatically

 

• Usage and technical data: IP address, device and browser information, pages visited, referrer, timestamps, and related analytics. 

 

c. Cookies & tracking technologies

 

• We use cookies and similar technologies to provide essential site functionality, remember preferences, and collect analytics data. See our Cookie Policy [link] for details.

 

d. Quiz data - how we treat quiz submissions (important)

 

• When you take a quiz on our Site:

   

  • Email address and marketing consent (if requested on the quiz) are forwarded directly to the Quiz Owner identified on that quiz page.  TR1BE does not retain or use those PII fields unless the Quiz Owner provides them to us under a signed Data Processing Agreement.

  • Non-PII quiz responses (e.g., your answer choices, archetype selection, scoring metadata, choice IDs) may be stored by TR1BE for analytics, product improvement, aggregate reporting, and to operate our services.  These non-PII quiz responses are stored separately from contact information and cannot be used by TR1BE to re-identify you unless the Quiz Owner later provides identifying data under a separate agreement. (See Retention below.)

 

 

4. How we use information

 

We use personal data for the following purposes:

 

• To operate, maintain, and improve the Site and Services. 

• To respond to enquiries and provide customer support.

• To send marketing communications if you have expressly opted in (newsletter, product updates).

• For security, fraud prevention, and compliance with legal obligations.

• For analytics, product improvement and aggregated reporting (non-PII quiz responses may be used in this way).

 

Important: TR1BE will not use or market to contacts collected by a Quiz Owner unless an explicit, documented agreement (such as a DPA + written marketing consent transfer) is in place.

 

 

5. Lawful basis for processing (where applicable)

 

Where required by applicable law (for users in the EU/UK and similar jurisdictions), TR1BE relies on:

 

• Consent - for marketing communications and non-essential cookies.

• Legitimate interests - for site operation, analytics, security and fraud prevention (balanced against your rights).

• Contractual/legal obligations - where processing is necessary to fulfil a contract or comply with law.

 

For quiz PII (email + consent), the Quiz Owner is responsible for obtaining and documenting lawful bases (typically consent) for contacting you.

 

 

6. Sharing & third-party processors

 

• We do not sell personal information. 

• We may share data with service providers who perform services on our behalf (hosting providers, analytics, CRM, email delivery, payment processors).  These providers act as processors under contract and are required to implement appropriate safeguards.

• For quiz PII: TR1BE forwards email and consent to the Quiz Owner; TR1BE keeps no copy of those PII fields unless a written Data Processing Agreement (DPA) is executed permitting TR1BE to process or store them on the Quiz Owner’s documented instructions.

• We may disclose personal data to comply with legal obligations, to protect rights, or in connection with mergers, acquisitions, or sale of assets (with notice where required).

 

 

7. Data Processing Agreements & co-operation with Quiz Owners

 

• If a Quiz Owner requests TR1BE to process or store identifying quiz submissions on their behalf, TR1BE and the Quiz Owner will execute a DPA that details categories of personal data, purposes of processing, security measures, sub-processors, incident notification timelines, and deletion obligations.  TR1BE will process data only on documented instructions from the Quiz Owner.

 

 

8. International transfers

 

Data may be transferred to, stored in, or processed in countries other than your residence (e.g., Canada, US, EU).  Where transfers occur, TR1BE will apply appropriate safeguards (e.g., standard contractual clauses, adequacy decisions, or explicit consent) as required by law.

 

 

9. Retention

 

• PII submitted via quizzes (email + consent): TR1BE does not retain copies of these fields.  Retention of those PII fields is controlled by the Quiz Owner and governed by the Quiz Owner’s privacy policy and retention schedule.

• Non-PII quiz responses stored by TR1BE: retained for 24 months (default) for analytics, product improvement, and aggregate reporting, after which data is deleted or irreversibly anonymized.  This retention period may be adjusted to meet regulatory or business needs - any change will be reflected in this policy.

• Site contact and newsletter data: retained until you unsubscribe or request deletion, subject to legal obligations.

• Usage logs / security logs: retained for a reasonable period (e.g., 12 months) for analytics, security, and fraud prevention.

 

 

10. Security

 

We implement reasonable administrative, technical, and physical safeguards designed to protect personal data from unauthorized access, loss, misuse, or disclosure, including encryption in transit (TLS), secure hosting, access controls, and vendor security assessments.  No system is 100% secure; in the unlikely event of a data breach affecting TR1BE-held data, we will follow our incident response plan and notify affected users and regulators as required by law.

 

 

11. Your rights

 

Where applicable (depending on your jurisdiction), you may have certain rights regarding your personal data: access, correction, deletion, restriction of processing, objection, portability, and the right to withdraw consent.  To exercise your rights for data controlled by TR1BE (e.g., non-PII quiz answers we store, newsletter contact), contact privacy@tr1bearcanum.com.  For quiz PII (email + consent) you should contact the Quiz Owner identified on the quiz page - their contact details are displayed on that page.

 

 

12. Cookies & tracking

 

We use cookies to enable site functionality, remember preferences, and collect analytics. A cookie banner will allow you to accept or decline non-essential cookies.  See our Cookie Policy [link] for more detail, including a list of cookies, purposes, and how to manage them via your browser.

 

 

13. Children

 

The Site is not intended for children under 13.  We do not knowingly collect personal information from children under 13.  If we learn that we have collected such information, we will delete it promptly. 

 

 

14. Third-party links & embedded content

 

The Site may contain links to third-party websites and embedded content (e.g., social media, video players).  We are not responsible for the privacy practices of third parties.  Please review their privacy notices before submitting personal information.

 

 

15. Changes to this policy

 

We may update this Privacy Policy from time to time.  When we do, we will post the updated policy on the Site and update the Effective Date.  Substantial changes will be highlighted where feasible.
